Participant Waiver

I, for myself, the minor participant (if a minor), my heirs, next of kin, personal representatives, successors, and assigns, do at this moment release, waive, discharge, covenant not to sue and agree to indemnify, save and hold harmless Real Volleyball Academy, LLC (RVA) and any of their officers, directors, independent contractors, employees, volunteers, event holders, event sponsors, event volunteers, shareholders and members from all liability claims, demands, losses or damages on this participant’s account from participant’s disability, personal injury, death, property damage, property theft or actions of any kind including participants travel to and from RVA facilities, locations, or events, caused or alleged to be caused in whole or in part by RVA and/or any of its officers, directors, independent contractors, employees, volunteers, event holders, event sponsors, event volunteers, shareholders and/or members, or otherwise (Released Parties). I further agree that if, despite this release, I, the participant, or anyone on the participant’s behalf claims any of the above-named released parties, I will indemnify, save, and hold harmless any of the above-named released parties from any litigation expenses, attorney fees, loss liability, damages, or costs any may incur as a result of any such claim. Assumption of Risk Physical activity, by its nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Specific injuries and risks vary from one activity to another. There is a potential for death, serious injury, and property loss. The risks include but are not limited to, those caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, and actions of other people, including but not limited to participants, volunteers, spectators, coaches, event officials, and/or producers of the event. I have read the Assumption of Risks paragraph and know, understand, and appreciate these and other risks inherent in the activities held at any of RVA facilities or locations. I, at this moment assert that my participation is voluntary and that I knowingly assume all such risks of death, injury, and/or property loss. Consent I, the undersigned parent or guardian/participant, grantnt grant authority to the staff at RVA to render a judgment concerning medical assistance or hospital care in the event of an accident or illness during my absence. I authorize RVA and its assigns to utilize any photographs, pictures, or other likenesses of me or anyone assigned guardianship to me as they deem appropriate in its promotional materials or team films. Acknowledgment of Understanding I have read this waiver of liability, release, indemnity agreement, and assumption of risk. I fully understand its terms, and understand that I am giving up substantial rights, including the right to sue. I acknowledge that I agree freely and voluntarily and intend to be a complete and unconditional release of all liability to the greatest extent allowed by law. By agreeing, the parent and/or legal guardian does at this moment represent that he/she is acting in such capacity and agrees to save and hold harmless and indemnify the released parties described above from all liability, loss, cost, claim or damage whatsoever which may be imposed upon said released parties because of any defect in or lack of such capacity to act so and release said parties on behalf of the minor and the parents or legal guardian.

I acknowledge that physical activities inherently involve risks that cannot be entirely eliminated, regardless of precautions taken. Such risks may result in death, serious injury, or property loss. These risks include, but are not limited to, those posed by terrain, facilities, weather conditions, equipment, vehicular traffic, and actions of other individuals involved in the activity. I understand and appreciate these risks and affirm that my participation is voluntary. I knowingly assume all risks associated with participation in activities held at RVA facilities or locations.

I acknowledge that the novel coronavirus/COVID-19 has been declared a worldwide pandemic by the World Health Organization. COVID-19 is highly contagious and is believed to spread primarily from person-to-person contact, including individuals without symptoms. To prioritize the health and safety of our staff and athletes, RVA has implemented the following guidelines:

- Only staff assigned to work and athletes scheduled to participate will be permitted inside the gym.

- Parents may remain in their vehicles in the parking lot while waiting for their athlete(s).

- Athletes waiting to enter a session must wait inside their cars until assigned check-in personnel allow entry.

- Detailed attendance records will be maintained for contact tracing purposes.

- Athletes and Staff must notify RVA Directors if ordered to quarantine by a government or health authority.

- Attendance is prohibited for individuals who have been in contact with a COVID-19 infected person within the last fourteen (14) days or exhibit symptoms such as fever, cough, shortness of breath, etc.

- Staff will remove anyone exhibiting COVID-19 symptoms from activities, with immediate notification to Directors.

- Adherence to State and Local social distancing guidelines, including bringing personal water bottles as drinking fountains will be closed.

- Compliance with all posted signage, protocols, and procedures.

- Direct movement to assigned seating upon check-in, avoiding contact and sharing of equipment or personal items.

I understand that while RVA has implemented preventive measures and enhanced cleaning protocols, it cannot guarantee protection against COVID-19. By signing/accepting this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily agree to assume the associated risks for myself and my child(ren). I release Real Volleyball Academy, its employees, agents, and representatives from any liability for claims, including those arising from COVID-19 infection, whether before, during, or after participation in RVA activities.

As the undersigned parent or guardian/participant, I grant authority to RVA staff to make judgments regarding medical assistance or hospital care in the event of an accident or illness during my absence. I also authorize RVA and its assigns to use any photographs, pictures, or likenesses of myself or the individual under my guardianship for promotional purposes or team films.

I have read and understood this waiver of liability, release, indemnification agreement, COVID-19 acknowledgment, consent, and assumption of risk. I acknowledge that by agreeing to these terms, I am relinquishing substantial rights, including the right to sue. I do so freely and voluntarily, intending it to be a complete and unconditional release of all liability to the greatest extent permitted by law. By agreeing, I represent that I am acting in my capacity as parent and/or legal guardian and agree to indemnify, save, and hold harmless the Released Parties from any liability, loss, cost, claim, or damage that may arise due to any defect in or lack of such capacity.
